1. Introduction 

  • This Privacy Notice explains in detail the types of personal data we may collect about you when you interact with us.  It also explains how we will store and handle that data and keep it safe. 

  • We know that there is a lot of information here, but we want you to be fully informed about your rights and how we use your data.

  • It is important that you read this notice together with any other Privacy Notice we may provide on specific occasions when we are collecting or processing personal information about you, so that you are aware of how and why we are using this information. This Privacy Notice supplements the other notices but is not intended to override them. 

  • Our Privacy Notice may be modified where there is a change to the way we process your personal data.  We may update this Privacy Notice from time to time to ensure that the information we provide to you is up to date an in accordance with the relevant data protection laws. Any new versions of this notice will be published on our website. 

2. Personal Data Controller

  • Our Privacy Notice applies to the personal data that we collect and use to provide you with a service. The Real Repair Company (Pty) Ltd is the controller and is responsible for your personal data collectively referred to as “TRRC”, “we”, “us” or “our” in this Privacy Notice. TRRC controls the way personal data is collected, and the purpose for which your personal data under the data protection laws that apply to us, like the Protection of Personal Information Act of 2020 (POPIA)

3. The Data We Collect About You

  • When we refer to “personal data” in this notice, we mean information that is related to you.  We may collect, use, store and transfer different kinds of personal data about you which we have grouped as follows: 

    • Identity Data – first name, last name and title.

    • Contact details – billing address, delivery address, email address, telephone number. 

    • Financial data- bank account and payment card details (if applicable).

    • Transactional Data – details about payments to and from you, as well as other details of products and services you have purchased from us.

    • Technical Data – Internet IP address, browser type and version, time zone and location, browser plug-in types and versions, operating systems and platform or other technology on the devices you use to access this website.

    • Profile data – purchases or orders made by you, your interest, preferences, feedback and survey responses. 

    • Usage Data – information about how you use our website, products and services.

    • Marketing and Communications Data – your preferences in receiving marketing from us and third parties, as well as communication preferences.

  • We also collect, use and share Aggregated Data such as statistical or demographical data, for any purpose. Aggregated data may be derived from your personal data but is not considered personal data in law, as this data does not directly or indirectly reveal your identity.  We may aggregate your usage data to calculate the percentage of users accessing a specific website feature.  However, if we combine or connect aggregated data with your personal data, it can directly or indirectly affect you. We treat the combined data as personal data which will be used in accordance with this Privacy Notice. 

  • We do not collect any Special Categories of personal data about you, including details about race, ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinion, trade union membership, information about health, genetic and biometric data.  We also do not collect information about criminal convictions and offences. 

  • If you fail to provide personal data where we need to collect personal data, or under the terms of a contract we have with you, or you fail to provide the requested data, we may not be able to fulfil the contract we currently have or are trying to enter with you.  In this case we may have to cancel a product / service you have with us. We will notify you if this is the case. 

  • Device Passcode: We collect the device passcode from customers so that we can fully test the functionality of a device before and after we conduct each repair.  The passcode is not used for any other purpose and no personal data is accessed as part of the functionality test.  The record of the passcode is deleted after each repair.  If you would prefer not to provide your passcode this may cause delays should any repair or adjustments need to be made following testing of the device upon collection. 

4. How is Your Personal Data Collected?

  • We use different methods to collect your data, including through direct interactions. You may provide us with your ID number, contact and financial data by completing forms, or by corresponding with us.  This includes personal data you provide when you:

    • apply for our products or services.

    • subscribe to our services.

    • request marketing materials to be sent to you.

    • enter a competition, promotion or survey. 

    • Give us feedback.

  • Automated technologies or interactions, as you interact with our website, we automatically collect technical data about your equipment, browsing actions and patterns.  We collect this personal data by using cookies, server logs and other similar technologies.  (Please see the cookies section – Point 14)

  • Third parties or publicly available sources. We may receive personal data about you from various third parties and public sources, such as analytics providers such as Google analytics or similar.

5. How And Why, We Use Your Personal Data 

  • We will only use your personal data when the law allows us to, in the following circumstances:

    • Where we need to verify personal details within the contract we are about to enter, or have entered into with you.

    • Where it is necessary for our legitimate interests, or third party, i.e. in the interest of the    business in conducting and managing our business to enable us to give you the best service product and the most secure experience.

    • Where we need to comply with a legal or regulatory obligation.

  • We may process your personal data for more than one lawful ground, depending on the specific purpose for which we are using your data. 

6. Marketing

  • We may use your ID, contact, technical and usage to form a view on what we think you may want or need, or what may be of interest to you. 

  • You will receive marketing communications from us if you have requested information from TRRC, or purchase services.  You also have the option to opt out of receiving such marketing. 

7. Change Of Purpose

  • We will only use your personal data for the purpose of which we collect it, unless we have reasonably considered that we need to use it for another reason which is compatible with the original purpose.

  • Should we need to use your personal data for any unrelated purpose, we will notify you and explain the legal basis which allows us to do so. 

8. Your Data Protection Rights

  • The POPIA act gives you specific rights that help you to control who has access to your personal data.  

  • For us to be able to process your request, you will need to provide us with the required information: 

    1. Your full name.

    2. A description of the data you give TRRC permission to access, including a date range, and an accurate description of the problem you are experiencing with your device.

    3. Email address you have used to book or communicate with us.

    4. An alternative contact number.

    5. Other information which may help locate your data (e.g. booking references).

  • If you submit a device for repair on behalf of another person, we will need to ensure that this person has authorized you to have their device assessed and repaired.

9. Data Access 

  • We do not store or copy your personal data. 

10. Data Rectification

  • If you believe that we hold incorrect or incomplete information about yourself, please contact us so we can correct it. You can do this by contacting our customer service team. 

11. Data Retention

  • We will only retain your personal data for as long as necessary, to fulfil the purpose we collected it for, including the purpose of satisfying any legal, accounting, repair assessment or reporting requirements. 

  • To determine the appropriate retention period for personal data, we consider the amount, nature, sensitivity of the personal data, as well as the potential risk of harm from unauthorised use or disclosure of personal data, the purposes for which we process your data and whether we can achieve those purposes through other means, as well as the applicable legal requirement.  By law we must keep basic customer information for five years after you cease being a customer for tax purposes. 

12. Withdrawing consent

  • Withdraw consent at any time where we are relying on consent to access your device. This will not affect the lawfulness of any process carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. 

13. Protecting Your Personal Data

  • We are committed to protecting the data we hold by taking the necessary security, technical and organizational measures against unlawful, unauthorised or accidental access, loss, destruction or damage to personal data. 

  • We limit access to your personal data to employees, agents, contractors and third parties who have a business need to know. They will only process your personal data on our instructions and are subject to a duty of confidentiality. We have put procedures in place to deal with any suspected personal data breach and will notify you, and any applicable regulator, if there is a breach, where we are legally required to do so.

14. Why We Use Cookie

  • To improve our services and provide you with more relevant content to analyse how visitors use our website, we may use technology such as cookies.  (Cookies are alphanumeric identifiers that are transferred to your computer’s hard drive through your web browser when you visit websites. They recognise your browser and track when you return to our website. All websites use cookies). 

  • TRRC protects the security of all your information during transmission by using the most up to date SSL software. Although we do our best to protect your personal information, we cannot guarantee the security of your data transmitted to our site and any data transmission is at your own risk. 

  • TRRC maintains physical, electronic and procedural safeguards in connection with collecting, storage and disclosure of personal customer information. 

15. Disclosure Of Personal Information

  • We may have to share your personal data with other companies for the purposes set out in this document. Service providers acting as processors based inside and outside the country who provide IT and system administration services, logistic services, and downstream processing.

  • We require that all third parties respect the security of your personal data and treat it in accordance with the law.  We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

  • We may, from time to time, amend our Privacy Notice and our terms and conditions. Unless stated otherwise, our current Privacy Notice applies to all information that we have received from you.

  • Our website may include links to third party websites, plug-ins and applications. Clicking on these links or enabling those connections may allow third parties to collect or shar data about you. We do not control these third-party websites nor are we responsible for their privacy statements. When you leave our website, we encourage you to check the Privacy Notice of every website you visit.
